An EPSHRM member asks, "Is a Texas employer required to garnish wages for 'order of withholding' from an out-of-state finance company to withhold for defaulted student loans?"
Gerry Howard from Kemp Smith replied, "The simple answer to this question is 'Yes.' To expand on this, under the federal Higher Education Act, 20 USC 1095a, which supercedes any state law to the contrary, when a person defaults on a student loan, the lending institution may obtain an administrative order for wage garnishment of up to 15% of the employee's wages. The Act includes many other provisions that affect the rights of the employee/borrower as well as address the obligations of the employer. If the employer has any doubt about the garnishment order or its obligations, we recommend that the employer have the order reviewed by an attorney."
